The news

On 14 October, the Competition and Markets Authority announced penalties of £4.8 million for Wayfair, £1.2 million for Appliances Direct and £45,000 for the UK Gold’s Gym franchise operator involved in its case. The CMA found false time-limited offers at Wayfair and Appliances Direct, automatic opt-ins to paid extras at Appliances Direct, and unclear presentation of mandatory joining fees at Gold’s Gym. It also announced customer refunds in the latter two cases. The authority said the businesses admitted breaches and settled. These are specific enforcement findings about consumer sales, not findings about Sandycroft or other businesses linked in this briefing.

Write down the actual offer first

Sandycroft analysis: before putting a promotion online, create one approved brief describing what is being offered, which products it covers and who will maintain it. If there is a genuine end date or quantity limit, identify the person responsible for checking that the wording stays accurate. An attractive design should follow an agreed offer rather than create a promise that the business has not planned to fulfil.

Read the customer journey on a phone as well as a desktop. Can someone understand the product, the price information and the next step without searching several pages? Check how VAT, delivery, personalisation and setup are described where relevant. Different business and consumer transactions can involve different requirements, so use the CMA’s linked guidance and appropriate professional advice for legal decisions.

Explain decoration choices without surprises

Workwear quotations are easier to compare when the garment, logo positions, quantities and decoration method are written down. Separate the options a buyer can choose from the work already agreed. If a customer changes the artwork or adds a second decoration position, confirm the revised brief before production rather than assuming an earlier conversation covered it.

A simple quotation template can help staff collect the same information each time. Keep the approved artwork and the final customer decision together so the production team does not have to reconstruct the order from several messages. These are organisational suggestions, not a certification that a particular checkout or contract complies with consumer law.

Keep printed and digital messages in step

A flyer or shop sign can remain in circulation after a website has changed. Give each campaign a named owner and keep a record of where the material is displayed. Check prices, dates, contact details and the destination of any QR code before approving a print run. Flintshire Printing is a relevant production route once the wording has been checked.

Use the same review for promotional gifts or branded clothing offered as part of a campaign. State clearly what the customer is being invited to enquire about, and avoid implying that an optional item is already included. At the end of the campaign, review the questions and complaints it generated as well as the sales. A clear offer should make the customer’s decision easier and the team’s work more predictable.
